Although the legal move by Jerry Sandusky made in waiving his right to a preliminary hearing may seem like a coward’s way out, it was likely a sound legal move. Former Penn State assistant football coach Jerry Sandusky waived his preliminary hearing, a decision that moves him toward a trial on charges of child sex abuse and vacates the possibility that he would face his accusers in court Tuesday.
Sandusky told reporters as he left the courthouse that he would "stay the course, fight for four quarters" and would present his side of the story later
A preliminary hearing amounts to a one-sided mini-trial. The prosecution gets to put on a case to establish probable cause. The burden of proof is very low. Once PC is established, the proceeding is over. The prosecution can put on evidence not admissible at trial. The Prosecutions presents just enough of its case to establish probable cause. The public hears the sensational aspects of the case but very little defense and no rebuttal. Generally, public opinion is turned against the Defendant. The Judge and potential jury pool hear some but not all of the evidence. Human nature teaches us that if you hear something often enough, you tend to believe it. That is not a good outcome for a Defendant in a criminal case.
The Long Island serial killer case is heating up. It is now where it began over a year ago. After a yearlong search, police on New York's Long Island announced Tuesday that they believe they have discovered the skeletal remains of a New Jersey prostitute whose disappearance sparked an investigation into a possible serial killing spree. With about a half-dozen news helicopters whirring overhead, Suffolk County Police Commissioner Police Commissioner Richard Dormer said searchers found the bones at around 9:15 a.m. in a dense wetland thicket, about a half mile from where 24-year-old Shannan Gilbert disappeared after meeting a client for an early-morning sexual encounter.
Dormer said the medical examiner's office would confirm whether the remains were Gilbert's, but the commissioner left little doubt that officers had found their intended target.
"It's certainly a sad day for the Gilbert family," he said. "And our condolences to that family on the death of their daughter."
The remains were found by homicide detectives aboard about a quarter mile from where authorities found Gilbert's pants, shoes, pocketbook with ID and other personal items last week. On Tuesday, they were searching on an aluminum amphibious vehicle equipped with pontoons that can maneuver over land and water when they came upon the remains.
Police were searching for the Jersey City, N.J., woman last December when they discovered the first of what would become 10 homicide victims. They were strewn along several miles of thicket and bramble along a parkway leading to Jones Beach. The body believed to be Gilbert's was several miles east from where the other 10 were located on the remote barrier island south of Long Island.
Thanks to Governor Milquetoast, Drew Peterson will never be put to death in Illinois. He is a waste of society’s limited resources and air. Former Bolingbrook police sergeant and murder suspect Drew Peterson believes that Illinois State Police should apologize for casting "a huge cloud of suspicion" on him by previously stating that his wife Stacy Peterson is "missing and presumed dead."
Peterson's request for an apology came via a press release issued Tuesday. The release points to an unrelated case where Judith Bello, a Washington woman, had been presumed dead as she had been missing for the past 18 years, but was recently discovered to be alive, living in California earlier this month. According to the release, Peterson "has always believed that Stacy is still very much alive" and that, because her mother disappeared once when Stacy was young, Joel A. Brodsky, Peterson's lead attorney, stated that "in Stacy’s mind disappearing may be 'normal.'"
"[The state police] made it seem like no woman, no mother, would ever just disappear, but as this most recent case shows, it does happen. In fact it happens more often than you would think," Brodsky said.
How long are Peterson and his lawyer going to release press alerts and why does the news keep covering them, like I am doing?
